Misdiagnosis of Infection

Failure to Diagnose Infection

A Navy Petty Officer’s two-year-old son was taken to a hospital at a Virginia Naval station when he complained of pain in both ears. After the boy was sent home with only a prescription of pain medication, the pain worsened.

Further examinations showed that the child suffered from a case of otitis media (middle ear infection) caused by Streptococcal bacteria. By the time this was determined, the child had gone deaf in both ears. Through the legal support of Swartz & Reed, a lawsuit was brought under the Federal Tort Claims Act in the US District Court, reaching a satisfactory settlement for the client.

Cases such as the story above illustrate the kind of work we at Swartz & Reed, LLP engage in on a daily basis. Due to the severity of infection cases and the time needed to prepare a strong case, we limit our case load. We take the time to devote our full attention to a case.

Handling Your Serious Infection Misdiagnosis Case

Undiagnosed or untreated infections, as in the illustration above, can have devastating outcomes. Having attorneys who have both military experience as well as knowledge of infectious diseases can be an asset at times when answers are needed.

Note: Case outcomes and results depend upon many factors that are unique to each case. Past results do not guarantee or predict a similar result in any future case undertaken by Swartz & Reed, LLP.
